Boston Alimony & Spousal Support Attorneys
Alimony is ongoing financial support payments that one spouse is legally required to make to the other until death or remarriage. During a divorce, this is the second most contentious matter after child custody.
In deciding alimony, Massachusetts law sets forth the factors the Court must consider (e.g. length of the marriage, lifestyle during the marriage, and earning potential of the spouses) but not how these factors must be weighed or balanced against each other. Further, unlike with child support calculations, there are no guidelines or formulas used to determine alimony. Instead, each Judge uses their own process for weighing the facts and relies on their own view of the appropriate “equitable” outcome.
With each Judge having a unique approach, similar cases and facts can be decided in very different ways by different Judges. This makes it important to hire an experienced alimony lawyer who understands your specific Judge’s approach and can craft the best specialized factual and legal arguments. Our attorneys at Baum & Dockter have extensive experience arguing before Judges in the Boston area and throughout Massachusetts; this experience helps us know the best arguments to make on your behalf.
